MEDIATION
Mediation is a process by which a mediator assists the parties to settle the dispute between them by facilitating conversations between the parties, assisting them in identifying concerns, clarifying priorities, discovering areas of compromise and creating options in an attempt to resolve the dispute.
Mediation is a form of Alternative Dispute Resolution. This refers to an alternative to litigation, which is a legal battle between parties. Mediation would be more efficient, less costly and faster alternative. As mediation is an uncontested court action, it has the smallest possible impact on children and parents.
A mediator is a neutral, legally qualified and accredited third party who intervenes to negotiate a legally binding out-of-court settlement. Should a settlement be reached, the settlement itself can be made an order of Court.
